1. Only if the owners of the IP explicitly approve of selling fan art/merch and only within what their policy allows. Known IPs with this permission include Warframe (Digital Extremes), Genshin Impact/Honkai series (miHoYo), Hades/Pyre/Transistor/Bastion (Supergiant Games), 33 Immortals/Spiritfarer/Sundered/Jotun (Thunder Lotus), Among Us (Innersloth), Nijisanji (ANYCOLOR), and Critical Role.
2. Must be 18+ to commission work with sexual content. See ToS article I, section f for restrictions and feel free to inquire.

Terms of Service
Updated as of: 2023 August 22These Terms of Service govern the relationship between you (“you”, “your”, or the “Client”) and me (“Sanctell”, “Aquila”) (hereinafter “I”, “me”, “my”, or the “Artist”) regarding the creation of a work of art (“Commission”, “Art[work], “Image[ry]”, “Project”, and “Work” are used interchangeably herein and in correspondence) commissioned by you.I reserve the right to, at my discretion, revise these Terms of Service without notice. By remitting payment for a Commission, you agree to be bound to these Terms of Service as they were written at the time of payment.DEFINITIONS
For the purposes of this document:
(1) the term "person" means "a member of a species that can perform abstract reasoning and communicate through speech, writing, signing, or telepathy";
(2) the term "animal" means "a member of a species that cannot perform abstract reasoning or communicate through speech, writing, signing, or telepathy";
(3) the term "child" means "a person with physiological development, emotional maturity, and reasoning ability relatively equivalent to the average human from birth to 13 years of age";
(4) the term "adolescent" means "a person with physiological development, emotional maturity, and reasoning ability relatively equivalent to the average human inclusively between 14 and 17 years of age"; and
(5) the term “legal adult” means “a person who is of or older than the age of majority under United States law, which is 18 years of age”.I. GENERAL TERMS
A. I reserve the right to decline any Commission request without obligation to provide reason.B. I reserve the right to stop work on a Commission, or cancel a Commission request, due to poor communication, rude or inappropriate behavior, inability to communicate effectively in the English language, or a breach of these Terms of Service.C. You may not submit a Commission request that may:
(1) communicate animosity, directly or indirectly, towards any real individuals or groups;
(2) defame any real persons or groups; or
(3) endorse any real political or religious entities.D. If your Commission request involves the use of third-party intellectual property (IP), then it will only be accepted if the owners of the IP explicitly allow derivative works to be made for profit. I may require you to provide evidence of such permission being granted.E. With respect to 47 U.S. Code § 223 and 47 U.S. Code § 231, you must be a legal adult to request a Commission featuring nudity or sexual acts (an “NSFW Commission”).F. If you are submitting an NSFW Commission request, then you must ensure it meets all of the following criteria:
(1) all characters to be depicted are fictional;
(2) all persons to be depicted participating in or witnessing sexual acts are in fact, regardless of their appearance, able to give consent by law or by custom in the context of the settings from which each of them originate;
(3) all characters to be depicted participating in or witnessing sexual acts are clearheadedly, knowingly, and freely consenting;
(4) any sexual acts to be depicted are conducted in a sanitary and safe manner, without any serious risk of death, infection, dismemberment, mutilation, nor psychological trauma; and
(5) with respect to 18 U.S. Code § 1466, 18 U.S. Code § 1466A, 18 U.S. Code § 2252A, and obscenity as defined by the Miller test, the subject matter may be judged to hold "serious artistic, literary, political, or scientific value" and does not feature, endorse, or condone:
[a] any sexual conduct or attraction towards or from children;
[b] any sexual conduct or attraction towards adolescents except from other adolescents; or
[c] any sexual conduct or attraction, mutual or unilateral, between an animal and a person.II. Payment
A. Prices are expressed in United States Dollars (USD). You are responsible for providing the correct amount equivalent to the USD amount.B. The total price of the Commission is subject to change at my discretion based on the requirements of the Commission.C. Payment to me must be made in full upfront prior to work on the Commission.III. CONFIDENTIALITY
A. You must provide to me a name/alias and valid email address for the purposes of processing payment and fulfilling the Commission.B. I will retain your personal data and communications between you and me regarding the Commission for a maximum of 120 days after payment.C. Your personal data and communications between you and me regarding the Commission will never be disclosed by me to any third-parties except:
(1) in cases which I am compelled to by law;
(2) if you make defamatory statements against me and the relevant information would disprove them; or
(3) if you file a dispute or initiate a chargeback against me.IV. PROCESS
A. Commissions may be requested via the “Commission Request” Google Forms that I provided or via email at [email protected].B. If the Commission request is accepted, then I will create up to twenty (20) sets of watermarked sketches based on your input until a sketch is approved. After payment is received, I will send an invoice via PayPal.C. Once the invoice is paid in full, I will begin work on the Commission and provide regular previews and written progress updates.D. You may ask for revisions during each progress update, but you may not ask for any changes to details which were finalized in the chosen sketch (e.g. concept, characters, poses, outfits, background, composition, rendering style) or a previous update (e.g. line, colors, small details, shading, effects, etc.)E. When the Commission is finished, I will send you the full resolution image in any file formats I am able to export to.V. COPYRIGHT AND USAGE
A. By commissioning me, you are purchasing only my labor. I retain all rights to the Commission, including but not limited to: distribution, reproduction, and use of the Commission in promotional materials. I also retain all rights to any preliminary designs and incidental works made in the creation of the Commission.B. You may request that I delay a public posting of the Commission as long as:
(1) you specify a date or duration for the delay, and
(2) the delay allows for me to post the Commission within the same year as its completion.C. You may request to have your name omitted as the commissioner from public postings of the Commission on my online accounts. In such cases, the commissioner will be credited as “Anonymous”.D. You may publicly display the Commission on online platforms as long as I am credited by my name (“Sanctell”).E. You may not profit from or alter the Commission without written permission from me.F. You may not use or solicit others to use the Commission, preliminary designs, or incidental works to create non-fungible tokens (NFTs) or generate a derivative image through the services of any third-parties, including artificial intelligence (AI).G. I have the right to pursue damages under United States Copyright Law should you violate it in addition to breaching these Terms of Services.VI. REFUNDS
A. Refunds will only be issued upon your request. If you request a refund, I will stop work on the Commission and transfer the money to you.B. I will provide a full refund if and only if I have provided no progress update since payment; otherwise, I will only provide a partial refund starting at 50% from the first progress update and decrementing by 5% after each subsequent progress update. No refund will be issued after 10 progress updates or if the Commission has been completed.C. I will not issue a refund if you breach any of these Terms of Service.D. If you file a dispute or request a chargeback against me, you forfeit all rights to the Commission and any of my other work. Additionally, I will never do business with you again.
