GENERAL

I choose which commissions to take on
I may accept or decline any Commission request for any reason, without obligation to disclose that reason, and I will not accept any Commission request that might constitute hate speech or endorse real political/religious groups.

I expect professional communication
I may stop work on a Commission due to rude or inappropriate behavior, poor language skills, absence of communication for more than 72 hours without notice, or a breach of these Terms of Service; except in the last case, you will be issued 1 (one) warning as a courtesy before I decide whether to stop work.

For lewd art, you must be 18+ years old
You must be at least 18 years or older to request artwork depicting either exposed genitals or explicit sexual activity. I label this type of art Adults Only (AO) to distinguish it from general usage of NSFW.

Lewd art must follow strict rules
If you are submitting an AO Commission request, then you must ensure it meets all of the following criteria:

No real people
All characters to be depicted are fictional and do not represent an identifiable person in real life unless they consented to modeling for that character.

Everyone shown must be able to consent
All persons to be depicted participating in or witnessing the acts are in fact, regardless of their appearance, able to consent to said acts by law or by custom in the context of the settings from which each of them originate.

Everyone shown must be consenting
All characters to be depicted participating in or witnessing romantic acts are clearheadedly, knowingly, and freely consenting.

No shock content or extreme kinks
All of the acts to be depicted are conducted in a sanitary and safe manner, without any serious risk of death, infection, dismemberment, mutilation, or psychological trauma.

No illegal content
The subject matter shall not in any way depict obscene conduct towards children or animals.

PAYMENT

I have final say over the total price
The total price of the Commission is subject to change at my discretion based on the requirements of the Commission.

I don’t start work until I get paid
Payment to me must be made in full upfront prior to work on the Commission via Artistree (https://artistree.io/sanctell).

CONFIDENTIALITY

I may keep records of our business
I may retain your personal data and communications between you and me regarding the Commission.

We shall respect each other's privacy
You shall refer to or address me by my aliases (“Sanctell” or “Aquila”) and never by my real name, should you learn it; I shall do the same for you if you also publicly go by an alias. Your personal data and communications between you and me regarding the Commission will never be disclosed by me to any others except:

in cases which I am compelled to by law;

if you make defamatory statements against me and the relevant information would disprove them; or

if you file a dispute or initiate a chargeback against me and the relevant information would resolve it.

PROCESS

You’ll get regular progress updates
Once the invoice is paid in full, I will begin work on the Commission, providing regular low-resolution previews and asking for feedback on each step of the process before moving forward. You may choose to grant me artistic freedom, meaning you will forgo the review process and accept the final Image as is, for a discounted price.

I won’t revise what you already approved
You may ask for revisions during each progress update, if you do not grant me artistic freedom, but you may not ask for any changes to details which were previously finalized.

You choose how to get the final product
When the Commission is finished, I will send you the full resolution Image in any file format of your choice that I am able to export to, and you may request additional versions that are cropped or lower resolution.

COPYRIGHT & USAGE

You’re paying for my labor, not the art
By commissioning me, you are purchasing only my labor. I retain all rights to the Art, including, but not limited to, distribution, reproduction, and use of the Art in promotional materials. I also retain all rights to any preliminary designs and incidental works that I may produce in the creation of the Art.

You can tell me to delay posting for a while
You may request that I delay publicly posting my Commission on social media as long as:

You specify a date or duration for the delay

The delay allows for me to post the Commission within the same calendar year as its completion.

You can ask to commission anonymously
You may request to have your name omitted as the commissioner from public social media posts of the Commission. In such cases, the commissioner will be credited as “Anonymous”.

You can tell me to delay posting for a while
You may publicly display the Commission on online platforms as long as I am credited.

Don’t try to monetize or claim my art
You will have a license to use the Art for noncommercial use only, unless we have entered into a separate contract for Projects aimed at commercial use. You may not otherwise profit from or alter the Art without written permission from me, nor may you attempt to claim the Art or an alteration of it as your own.

Don’t involve me or my art in NFTs or AI
You may not use the Commission, preliminary designs, or incidental works to create non-fungible tokens (NFTs) or generate a derivative image through the services of any third parties, including generative artificial intelligence (genAI).

REFUNDS

You’ll let me handle the refund process
If I stop work on the Commission or you request a refund, then I shall initiate the refund process with Artistree.

Refunds are based on work/time invested
Should the refund process be initiated, you agree to be refunded based on the amount of progress I have shown you: You may receive a full refund if I have not provided any progress update since payment. After the first progress update, putting the commission in the sketch stage, you may only seek a partial refund starting at 50% and decreasing by 10% as the Project goes through the subsequent stages of the drawing process– lining (40%), coloring (30%), and rendering (20%). You may not seek any refund once the Commission has been completed.

You’ll be blacklisted for foul play
If you attempt to scam or defraud me, you forfeit all rights to the Commission and any of my other work. Additionally, I will never do business with you again and will make the incident known to other artists.
