Terms of Service

Updated as of: 2024 August 22A summary of this TOS has been written as non-highlighted bullet-point headers in bold text for ease of reading only; they and this sentence are not part of the actual TOS.These Terms of Service govern the relationship between you (“you”, “your”, or the “Client”) and me (“Sanctell”, “Aquila”) (hereinafter “I”, “me”, “my”, or the “Artist”) regarding the creation of a work of art (“Commission”, “Art[work], “Image[ry]”, “Project”, and “Work” are used interchangeably herein and in correspondence) commissioned by you.I reserve the right to, at my discretion, revise these Terms of Service without notice. By remitting payment for a Commission, you agree to be bound to these Terms of Service as written at the time of payment.

  1. GENERAL

  1. I may refuse commissions for any reason
    I reserve the right to decline any Commission request for any reason, without obligation to disclose that reason, and I will not accept any Commission request that may constitute hate speech, defamation, or political/religious endorsement.

  2. I expect professional communication
    I reserve the right to stop work on a Commission due to rude or inappropriate behavior, poor language skills, absence of communication for more than 72 hours, or a breach of these Terms of Service; except in the last case, you will be issued 1 (one) warning as a courtesy before I decide whether to stop work.

  3. For NSFW art, you must be 18+ y.o.
    With respect to 47 U.S. Code § 223 and 47 U.S. Code § 231, you must be a legal adult to request a Commission featuring nudity or sexual acts (“Adult-Oriented”, “AO”, “Hentai”, “Not Safe For Work”, or “NSFW”).

  4. NSFW art must follow strict rules
    If you are submitting an AO Commission request, then you must ensure it meets all of the following criteria:

  1. No real people
    all characters to be depicted are fictional and do not represent an identifiable person in real life unless they consented to modeling for that character;

  2. Everyone shown must be able to consent
    all persons to be depicted participating in or witnessing sexual acts are in fact, regardless of their appearance, able to consent to sex by law or by custom in the context of the settings from which each of them originate;

  3. Everyone shown must be consenting
    all characters to be depicted participating in or witnessing sexual acts are clearheadedly, knowingly, and freely consenting;

  4. No shock content or extreme kinks
    any sexual acts to be depicted are conducted in a sanitary and safe manner, without any serious risk of death, infection, dismemberment, mutilation, or psychological trauma; and

  5. No illegal/obscene content
    with respect to 18 U.S. Code § 1466, 18 U.S. Code § 1466A, 18 U.S. Code § 2252A, and obscenity as defined by the Miller test, the subject matter may be judged to hold “serious literary, artistic, political, or scientific value” and does not feature:

  1. No CSA
    any sexual conduct towards or from humans less than or at 13 years of age, physically or mentally, and other species persons of similar development;

  2. No legal minor x adult
    any sexual conduct towards humans inclusively between 14 and 17 years of age, physically or mentally, and other species persons of similar development, except from their peers; or

  3. No bestiality
    any sexual conduct, mutual or unilateral, between a human or other species person and a non-sapient organism.

  1. PAYMENT

  1. I have final say over the total price
    The total price of the Commission is subject to change at my discretion based on the requirements of the Commission. I may add more charges as I deem appropriate for the Commission requirements.

  2. I don’t start work until I get paid
    Payment to me must be made in full upfront prior to work on the Commission via Artistree (artistree.io).

  1. CONFIDENTIALITY

  1. I may keep records of our business
    I may retain your personal data and communications between you and me regarding the Commission.

  2. I won’t share private info unless necessary
    our personal data and communications between you and me regarding the Commission will never be disclosed by me to any third-parties except:

  1. in cases which I am compelled to by law;

  2. if you make defamatory statements against me and the relevant information would disprove them; or

  3. if you file a dispute or initiate a chargeback against me and the relevant information would resolve it.

  1. PROCESS

  1. All communications go through Artistree
    Commissions may be requested via my Artistree commission page (https://artistree.io/sanctell) and any communications are to go through the site messaging system unless there are extenuating circumstances. You will be expected to include image references or a complete written description of every character, object, or scene to be drawn as part of your Commission.

  2. You’ll get regular progress updates from the start
    Once the invoice is paid in full, I will begin work on the Commission and provide regular low-resolution previews and ask for feedback on each step of the process before moving forward.

  3. I won’t revise what you already approved
    You may ask for revisions during each progress update, but you may not ask for any changes to details which were finalized in the chosen sketch (e.g. concept, characters, poses, outfits, background, composition, rendering style) or a previous update (e.g. line, colors, small details, shading, effects, etc.)

  4. You get the final image however you like
    When the Commission is finished, I will send you the full resolution image in any file format of your choice that I am able to export to, and you may request additional versions that are cropped or lower resolution.

  1. COPYRIGHT & USAGE

  1. You’re paying for my labor, not the art
    By commissioning me, you are purchasing only my labor. I retain all rights to the Commission, including, but not limited to, distribution, reproduction, and use of the Commission in promotional materials. I also retain all rights to any preliminary designs and incidental works that I may produce in the creation of the Commission.

  2. You can tell me to delay posting for a while
    You may request that I delay publicly posting my Commission on social media as long as:

  1. you specify a date or duration for the delay, and

  2. the delay allows for me to post the Commission within the same calendar year as its completion.

  1. You can ask to commission anonymously
    You may request to have your name omitted as the commissioner from public social media posts of the Commission. In such cases, the commissioner will be credited as “Anonymous”.

  2. You can tell me to delay posting for a while
    You may publicly display the Commission on online platforms as long as I am credited by my business name (“Sanctell”).

  3. Don’t try to monetize or claim my art
    You may not profit from or alter the Commission without written permission from me, nor may you attempt to claim the Commission or an alteration of it as your own.

  4. Don’t involve me or my art in NFTs or AI
    You may not use the Commission, preliminary designs, or incidental works to create non-fungible tokens (NFTs) or generate a derivative image through the services of any third-parties, including artificial intelligence (AI).

  1. REFUNDS

  1. You have to ask to get a refund
    Refunds will only be issued upon your request. If you make a refund request, I will stop work on the Commission and have the money transferred to you.

  2. I’ll refund based on how much work I did
    I will provide a full refund if and only if I have provided no progress update since payment; otherwise, I will only provide a partial refund starting at 50% from the first progress update and decrementing by 5% after each subsequent progress update. No refund will be issued after 10 progress updates or if the Commission has been completed.

  3. I’ll blacklist you if you try a chargeback fraud
    If you file a dispute or request a chargeback against me, you forfeit all rights to the Commission and any of my other work. Additionally, I will never do business with you again and will make the incident known to other artists.
